E4S Consulting Services, LLC (“Company”, “E4S”, “us”, or “we”) has created this Information Security and Privacy Policy (the “Policy”) in order to document and communicate its commitment to doing business with the highest ethical standards and appropriate internal controls.  We respect your privacy.  Information you entrust to E4S will be handled with the greatest care, and we will not use the information in ways to which you have not consented or is not required by law.  This privacy notice does not apply to products, software tools, or other services we use from Service Providers.  Service Providers are separate legal entities who are responsible for their own information security and privacy policies.

By using or accessing E4S’ Website, you are accepting the practices described in this Policy.

Policy Scope

This Policy applies to E4S-owned websites and domains, namely, https://www.e4sprotraining.com and https://www.e4sconsultingservices.com.  Both websites are referred as the "Sites" within this policy.

The Sites, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a surfing and curated shopping experience (the "Services"). E4S Pro Training is powered by Shopify, which enables us to provide an E-commerce platform to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Definitions

Cookies - small pieces of data stored on your device (computer or mobile device)

Data Controller - the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed.  For the purpose of this Policy, E4S is a Data Controller of your Personal Data.

How We Use Your Personal Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

  • Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders (including training and course registrations), to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.
  • Training/Educational Credits and Certificates.  When you register for a training or course, we will collect and store necessary information to process your credits and certificates according to your designations that we have collected from you.  We may maintain this information electronically up to three (3) years for record retention purposes within our encrypted training database.
  • Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services.
  • Security and Fraud Prevention. We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.
  • Communicating with You. We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you.

  • With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).
  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites.   • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.
  • In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Relationship With Shopify

E4S Pro Training Online Store is hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. Posting Testimonials & Endorsements on Our Website

E4S encourages clients to provide feedback.  In addition, we routinely request impact outcome reviews from our clients’ senior stakeholders to evaluate our performance in delivering desired results and to measure our success of sustaining our vision as a trusted change agent.  The information shared with us are posted to our website in truth.  When you provide an endorsement or testimony, you agree to allow E4S to publish the response on its website, in print publications, or other electronic, publicly shared sources.  These responses are maintained by E4S indefinitely.

Legal Basis for Processing Personal Data Under General Data Protection Regulation (GDPR)

If you are from the European Economic Area (EEA), E4S legal basis for collecting and using the personal information described in this Policy depends on the Personal Data we collect and the specific context in which we collect it.  E4S may process your Personal Data because:

  • We need to develop and execute a contract with you
  • You have given us permission to do so
  • The processing is in our legitimate interests, and it is not overridden by your rights
  • For payment processing purposes

Retention of Data

E4S will retain your Personal Data only for as long as is necessary for the purposes set out in this Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.  Furthermore, we will also retain Usage Data for internal analysis purposes. Under certain circumstances, E4S may be required to disclose your Personal Data by law or in response to valid requests by public authorities (e.g., a court or a government agency).

The security of your data is important to us.  Remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. "Do Not Track” Signals

We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.  You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Your Data Protection Rights Under General Data Protection Regulation (GDPR)

E4S aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.  If you wish to be informed about the Personal Data we hold about you, and if you want it to be removed from our systems, please contact us.  In certain circumstances, you have the following data protection rights:

    • You have the right to have your information rectified if the information is inaccurate or incomplete.
  • The right to object:
    • You have the right to object to our processing of your Personal Data.
  • The right of restriction:
    • You have the right to request that we restrict the processing of your personal information.

    • Depending on where you reside, you may have a right to opt out of the "sale" or "share" of your personal information or to opt out of the processing of your personal information for purposes considered to be "targeted advertising", as defined in applicable privacy laws. Third Party Access to Your Personal Information (Service Providers)

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related services, or to assist us in analyzing how our Service is used.  In these cases, third parties access your personal information for processing business transactions and other related services/offerings.  Website visitors, existing and new customers, as well as potential customers, should carefully read the privacy policies and any terms and conditions applicable to these Service Providers.

All website visitors, existing and new customers, as well as potential customers, agree not to hold E4S liable for any information security and privacy policy violations associated with any Service Providers.

Social Media Links
We may use hyperlinks on the E4S’ web site, which will redirect you to a social media network if you click on the respective link. When you click on a social plug-in, such as LinkedIn, or other social media platforms, that particular social network’s plugin will be activated, and your browser will directly connect to that provider’s servers. If you do not use these buttons, none of your data will be sent to the respective social network’s plugin provider. So, for example, when you click on the LinkedIn link on the web site, LinkedIn will receive your IP address, the browser version and screen resolution, and the operating system of the device you have used to access the web site. Settings regarding privacy protection can be found on the websites of these social networks and are not within our control.

Adobe Connect, Microsoft Teams, & Zoom (Online Meeting and Conference Technologies)
E4S uses Adobe Connect, Microsoft Teams, and Zoom technologies for online meetings, virtual trainings, online conferences, etc.  As such, all users of E4S’ services should review these Service Providers’ privacy policies and compliance statements.  By joining Zoom and/or Microsoft Teams sessions with E4S or its affiliates, you agree not to hold E4S accountable for any information security or privacy breaches. Payments

We may provide paid products and/or offerings within the Service. In that case, we use third-party services for payment processing (e.g., payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors may adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. Service Delivery Providers

Children's Privacy

Our Service does not address anyone under the age of 18 ("Children").  We do not knowingly collect personally identifiable information from anyone under the age of 18.  If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we will take steps to remove that information from our servers.

The E4S Website is protected with a variety of security measures such as change control procedures, passwords, and physical access controls. We also employ a variety of other mechanisms to ensure that data you provide is not lost, misused, or altered inappropriately.
