Terms of Use Agreement

Agreement Scope

This agreement applies to E4S-owned websites and domains, namely https://www.e4sconsultingservices.com and https://www.e4sprotraining.com.  Both are referenced as "The Site".

Welcome to the Site.  E4S Consulting Services LLC ("E4S" or "We") maintains the Site as a service to our visitors and customers.  By accessing or using the Site (or any applications, including our chat, learning management platform, support, or other associated applications made available by E4S or its third-party providers), you are agreeing to comply with and be bound by the following terms of use.  These terms of use affect your legal rights and obligations and form a binding agreement between E4S and you (the "Agreement").  Please review the following Agreement terms carefully. If you do not agree to these terms, you should not review information or obtain goods or products from this Site.

Basic Terms

In using the Site, you agree to the following basic terms:

1.1. You must be at least 18 years old to use the Site.

1.2. You may not post, upload or share, or otherwise generate through the Site violent, discriminatory, unlawful, infringing, hateful, pornographic or sexually suggestive content via the Site.

1.3. You are responsible for any activity that occurs through your account, and you agree you will not sell, transfer, license or assign your account, followers, username, account information, or any account rights.  With the exception of people or businesses that are expressly authorized to create accounts on behalf of their employers or clients, E4S prohibits the creation of, and you agree that you will not create an account for anyone other than yourself. You also represent that all information you provide or provided to E4S upon registration and at all other times will be true, accurate, current and complete, and you agree to update your information as necessary to maintain its truth and accuracy.

1.4. You agree that you will not solicit, collect or use the login credentials of other E4S users.

1.5. You are responsible for keeping your password secret and secure.

1.6. You must not defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate people or entities and you must not post private or confidential information via the Site, including your or any other person's credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.

1.7. You may not use the Site for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Site and your Content (defined below), including copyright laws.

1.8. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials, including any outputs, results, content, or materials generated using any artificial intelligence provider or any other third party provider (collectively, "User Content") that you submit, post or display on or via the Site.

1.9. You must not change, modify, adapt or alter the Site or change, modify or alter another website so as to falsely imply that it is associated with the Site or E4S.

1.10. You must not create or submit unwanted email, comments, likes or other forms of commercial or harassing communications (a/k/a "spam") to any E4S users.

1.11. You must not use domain names or web URLs in your username without prior written consent from E4S.

1.12. You must not use E4S' name, logo, trademarks, service marks, or other branding elements without E4S' prior written consent to be decided on a case-by-case basis.  Such consent, if granted, is subject to revocation by E4S at any time.  Any authorized use of the foregoing shall comply with E4S' then-current trademark usage and branding guidelines.

1.13. You must not interfere, disable, impair, reverse engineer, or disrupt the Site or servers or networks connected to the Site, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature.  You may not inject content or code or otherwise alter or interfere with the way any E4S page is rendered or displayed in a user's browser or device.

1.14. You must not create accounts with the Site (or otherwise attempt to access the Site or any content or other material on the Site) through unauthorized means, including by using an automated device, script, bot, spider, crawler or scraper.

1.15. You must not use the Site in any manner that could disable, overburden, damage, or impair the Site, or interfere with any other use of the Site.

1.16. You must not attempt to restrict another user from using or enjoying the Site and you must not encourage or facilitate violations of this Agreement or any other E4S terms.

1.17. You must not mislead anyone that the User Content has all the proper rights, licenses, and ownership if it may not.

1.18. In the case of any User Content, material, result, or decision is generated by artificial intelligence and uploaded on the Site, you may not mislead that such User Content, material, result, or decision human-generated and agree to include a disclosure that such generated content was created by artificial intelligence.

1.19. You must not port, display, copy, outsource, republish, frame, sublicense, resell, host, or stream any aspect of this Site or otherwise commercially exploit the Site, including extracting data or information from the Site to train any artificial intelligence models.

1.20. You must not use the Site to provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to Section 219 of the Immigration and Nationality Act or other laws and regulations concerning national security, defense or terrorism.

1.21. You must not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person, organization, or entity, including E4S.

1.22. You must not post, upload, or share through the Site any sensitive or special categories of data as defined by the General Data Protection Regulation (GDPR).

1.23. Violation of this Agreement may, in E4S' sole discretion, result in termination of your E4S account and/or access to the Site. You understand and agree that E4S cannot and will not be responsible for the User Content posted on the Site, and you use the Site at your own risk.  If you violate the letter or spirit of this Agreement or otherwise create risk or possible legal exposure for E4S, we can stop providing all or part of the Site to you.

General Terms & Conditions

2.1. Scope of Agreement
This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site; the content, products, or services provided by or through the Site; and the subject matter of this Agreement. E4S reserves the right, in its sole discretion, to change this Agreement ("Updated Agreement") from time to time.  Notwithstanding the foregoing, these Terms of Use do not apply to the provision, purchase, or use of or access to the E4S products or services, which are governed by our Terms and Conditions of our services. Unless we make a change for legal or administrative reasons, we will provide reasonable advance notice before the Updated Agreement becomes effective.  You agree that we may notify you of the Updated Agreement by posting it on the Site, and that your use of the Site after the effective date of the Updated Agreement (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Agreement.  Therefore, you should review this Agreement and any Updated Agreement before using the Site.  The Updated Agreement will be effective as of the time of posting, or such later date as may be specified in the Updated Agreement and will apply to your use of the Site from that point forward.  This Agreement will govern any disputes arising before the effective date of the Updated Agreement. We reserve the right to modify, suspend, or terminate access to the Site, including deleting any content, for any reason, without notice, at any time, and without liability to you. If we terminate your access to the Site, your User Content may no longer be accessible, but it may persist and appear on the Site (e.g., if your User Content has been reshared by others).

2.2. E4S Content and User Content
E4S Content.  The Site contains content owned or licensed by E4S ("E4S Content").  E4S Content is protected by copyright, trademark, patent, trade secret and other laws, and, as between you and E4S, E4S and its third-party providers owns and retains all rights in the E4S Content and the Site. There is one type of E4S Content: (a) downloadable assets.

Downloadable Assets.  An example of a downloadable asset is a PowerPoint presentation, video, or training materials that E4S provides. All other rights are reserved.  As a user, you are authorized only to view, copy, print, and distribute documents from E4S so long as (1) the asset is used for informational purposes only, and (2) any copy of the document (or portion thereof) includes the following copyright notice: Copyright © 2020 E4S Consulting Services, LLC.  All rights reserved.  Accordingly, you may not distribute, modify, or host downloadable assets as your own content (or permit any third party to do so).

There are no implied licenses hereunder, and any right not expressly granted are reserved by E4S and its licensors.  Without limiting the generality of the foregoing, you will not remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the E4S Content, and you will not reproduce, modify, adapt, prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license or otherwise exploit the E4S Content.  If you post User Content to the Site, then the following terms apply.

User Content.  E4S does not claim ownership of any User Content that you post on or through the Site.  Instead, you hereby grant to E4S a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the User Content that you post on or through the Site, for all purposes described in and contemplated by this Agreement, as well as for E4S' publicity purposes (including as part of a user testimonial on the Site).  You represent and warrant that: (i) you own the User Content posted by you on or through the Site, or otherwise have the right to grant the rights and licenses set forth in this Agreement; (ii) the posting and use of your User Content on or through the Site does not violate, misappropriate or infringe on the rights of any third party, including privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of User Content you post on or through the Site; (iv) you have the legal right and capacity to enter into this Agreement in your jurisdiction; and (v) you will comply with all applicable laws.  The copying, redistribution, use, or publication by you of any such matters or any part of the Site, except as allowed in this Agreement, is strictly prohibited.  You do not acquire ownership rights to any E4S Content, or other user content, document, or other materials that you view (but do not post) through the Site.  The posting of User Content on the Site does not constitute a waiver of any right in such information and materials.

3. Trademarks
All brand, product, service, and process names appearing on this Web site are trademarks of their respective holders.  Reference to or use of a product, service, or process does not imply recommendation, approval, affiliation, or sponsorship of that product, service, or process by E4S.  Nothing contained herein shall be construed as conferring by implication, estoppel, or otherwise any license or right under any patent, copyright, trademark, or other intellectual property right of E4S Consulting Services, LLC or any third party, except as expressly granted herein.

4. License Termination
Upon termination of this Agreement, all licenses and other rights granted to you under this Agreement will immediately cease.

5. Editing, Deleting, and Modification
You agree that E4S is not responsible for, and does not endorse, User Content or Feedback (defined below) posted within the Site. E4S does not have any obligation to prescreen, monitor, edit, or remove any User Content.  If your User Content violates this Agreement, you may bear legal responsibility for that User Content.  You agree that any User Content will be non-confidential and non-proprietary, and we will not be liable for any use or disclosure of User Content.  You acknowledge and agree that your relationship with E4S is not a confidential, fiduciary, or other type of special relationship, and that your decision to submit any User Content or Feedback does not place E4S in a position that is any different from the position held by members of the general public, including with regard to your User Content or Feedback.  None of your User Content will be subject to any obligation of confidence on the part of E4S, and E4S will not be liable for any use or disclosure of any User Content you provide.  Without limiting the generality of the foregoing, we reserve the right in our sole discretion to edit or delete any documents, information, or other content appearing on the Site.

6. Indemnification
You (and also any third party for whom you operate an account or activity on the Site) agree to defend (at E4S' request), indemnify and hold E4S and its affiliates and their employees, officers, directors, agents, successors and assigns (collectively, the "E4S Parties") harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with any of the following (including as a result of your direct activities on the Site or those conducted on your behalf): (i) your User Content or your access to or use of the Site; (ii) your breach or alleged breach of this Agreement; (iii) your violation of any third-party right, including any intellectual property right, publicity, confidentiality, property or privacy right; (iv) your violation of any laws, rules, regulations, codes, statutes, ordinances or orders of any governmental and quasi-governmental authorities, including all regulatory, administrative and legislative authorities; or (v) any misrepresentation made by you. You will cooperate as fully required by E4S in the defense of any claim.  E4S reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you will not in any event settle any claim without the prior written consent of E4S.

7. Assignment
Your right to use the Site and/or any licenses granted under this Agreement are not assignable or transferable, including by operation of law or otherwise. Any attempted assignment or transfer in violation of the foregoing is null and void.

8. Warranty Disclaimer
THE INFORMATION FROM OR THROUGH THE PUBLIC AREAS OF THIS SITE IS PROVIDED "AS-IS" AND "AS AVAILABLE" TO THE FULLEST EXTENT POSSIBLE BY LAW. TO THE FULLEST EXTENT POSSIBLE BY LAW, THE E4S PARTIES, ON BEHALF OF THEMSELVES AND ANY AND ALL THIRD PARTY USER CONTENT PROVIDERS, DO NOT MAKE ANY REPRESENTATIONS OR WARRANTIES OR ENDORSEMENTS OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED OR STATUTORY AS TO THE SITE, E4S CONTENT, ANY THIRD PARTY USER CONTENT, OR ANY SECURITY ASSOCIATED WITH THE TRANSMISSION OF INFORMATION TO E4S OR VIA THE SITE, ALL OF WHICH ARE HEREBY DISCLAIMED (INCLUDING THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, CUSTOM, TRADE, QUIET ENJOYMENT, SYSTEM INTEGRATION, AND FREEDOM FROM COMPUTER VIRUS). THE INFORMATION AND SITE MAY CONTAIN BUGS, ERRORS, PROBLEMS, OR OTHER LIMITATIONS. THE E4S PARTIES ON BEHALF OF THEMSELVES AND ANY AND ALL THIRD PARTY USER CONTENT PROVIDERS, DO NOT REPRESENT OR WARRANT THAT THE SITE OR THIRD PARTY USER CONTENT WILL BE ERROR-FREE OR UNINTERRUPTED; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR THE SERVER THAT MAKES THE SITE AVAILABLE IS FREE FROM ANY HARMFUL COMPONENTS, INCLUDING VIRUSES AND OTHER FORMS OF MALWARE. THE E4S PARTIES DO NOT MAKE ANY REPRESENTATIONS OR WARRANTIES THAT THE INFORMATION (INCLUDING ANY INSTRUCTIONS AND/OR THIRD PARTY USER CONTENT) ON THE SITE IS ACCURATE, COMPLETE, OR USEFUL. YOU ACKNOWLEDGE THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK. YOU SHALL NOT RELY ON ANY INFORMATION FOUND ON THE SITE FOR ANY MEDICAL, LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE. THE E4S PARTIES ON BEHALF OF THEMSELVES AND ANY AND ALL THIRD PARTY USER CONTENT PROVIDERS, DO NOT WARRANT THAT YOUR USE OF THE SITE OR THIRD PARTY USER CONTENT IS LAWFUL IN ANY PARTICULAR JURISDICTION, AND THE E4S PARTIES, ON BEHALF OF THEMSELVES AND ANY AND ALL THIRD PARTY USER CONTENT PROVIDERS, SPECIFICALLY DISCLAIM SUCH WARRANTIES. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTION'S LAW IS APPLICABLE TO YOU AND THIS AGREEMENT.

BY ACCESSING OR USING THE SITE, YOU REPRESENT AND WARRANT THAT YOUR ACTIVITIES ARE LAWFUL IN EVERY JURISDICTION WHERE YOU ACCESS OR USE THE SITE.

THE E4S PARTIES DO NOT ENDORSE THIRD PARTY USER CONTENT AND SPECIFICALLY DISCLAIM ANY RESPONSIBILITY OR LIABILITY TO ANY PERSON OR ENTITY FOR ANY LOSS, DAMAGE (WHETHER ACTUAL, CONSEQUENTIAL, PUNITIVE OR OTHERWISE), INJURY, CLAIM, LIABILITY OR OTHER CAUSE OF ANY KIND OR CHARACTER BASED UPON OR RESULTING FROM ANY THIRD PARTY USER CONTENT.

9. Limitation of Liability
UNDER NO CIRCUMSTANCES WILL THE E4S PARTIES BE LIABLE TO YOU FOR ANY LOSS OR DAMAGES OF ANY KIND (INCLUDING FOR ANY DIRECT, INDIRECT, ECONOMIC, EXEMPLARY, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES) THAT ARE DIRECTLY OR INDIRECTLY RELATED TO: (A) THE SITE; (B) THE E4S CONTENT; (C) USER CONTENT; (D) YOUR USE OF, INABILITY TO USE, OR THE PERFORMANCE OF THE SITE; (E) ANY ACTION TAKEN IN CONNECTION WITH AN INVESTIGATION BY THE E4S PARTIES OR LAW ENFORCEMENT AUTHORITIES REGARDING YOUR OR ANY OTHER PARTY'S USE OF THE SITE; (F) ANY ACTION TAKEN IN CONNECTION WITH COPYRIGHT OR OTHER INTELLECTUAL PROPERTY OWNERS; (G) ANY ERRORS OR OMISSIONS IN THE SITE'S OPERATION; OR (H) ANY DAMAGE TO ANY USER'S COMPUTER, MOBILE DEVICE, OR OTHER EQUIPMENT OR TECHNOLOGY INCLUDING DAMAGE FROM ANY SECURITY BREACH OR FROM ANY VIRUS, BUGS, TAMPERING, FRAUD, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER LINE OR NETWORK FAILURE OR ANY OTHER TECHNICAL OR OTHER MALFUNCTION, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, EVEN IF FORESEEABLE OR EVEN IF THE E4S PARTIES HAVE BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR TORT (INCLUDING WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE, ACTS OF GOD, TELECOMMUNICATIONS FAILURE, OR THEFT OR DESTRUCTION OF THE SITE). IN NO EVENT WILL THE E4S PARTIES BE LIABLE TO YOU OR ANYONE ELSE FOR LOSS, DAMAGE OR INJURY, INCLUDING DEATH OR PERSONAL INJURY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT WILL THE E4S PARTIES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OR ACTION EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100.00).

YOU AGREE THAT IN THE EVENT YOU INCUR ANY DAMAGES, LOSSES, OR INJURIES THAT ARISE OUT OF E4S' ACTS OR OMISSIONS, THE DAMAGES, IF ANY, CAUSED TO YOU ARE NOT IRREPARABLE OR SO INSUFFICIENT THAT THEY MIGHT ENTITLE YOU TO AN INJUNCTION PREVENTING ANY EXPLOITATION OF ANY SITE, SERVICE, PROPERTY, PRODUCT OR OTHER CONTENT OWNED OR CONTROLLED BY THE E4S PARTIES, AND YOU WILL HAVE NO RIGHTS TO ENJOIN OR RESTRAIN THE DEVELOPMENT, PRODUCTION, DISTRIBUTION, ADVERTISING, EXHIBITION OR EXPLOITATION OF ANY SITE, PROPERTY, PRODUCT, SERVICE, OR OTHER CONTENT OWNED OR CONTROLLED BY THE E4S PARTIES.

E4S IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE ALL E4S PARTIES FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES.

10. Use of Information; Feedback
We reserve the right, and you authorize us, to use and assign all information regarding Site uses by you and all information provided by you in any manner, consistent with our Privacy Notice. It is E4S' policy not to accept or consider content, information, ideas, suggestions or other materials other than those we have specifically requested and to which certain specific terms, conditions and requirements may apply.  This is to avoid any misunderstandings if your ideas are similar to those we have developed or are developing independently.  Accordingly, E4S does not accept unsolicited materials or ideas, and takes no responsibility for any materials or ideas so transmitted.  If you choose to send us content (other than User Content), information, ideas, suggestions, or other materials (“Feedback”), whether solicited or unsolicited, you agree that E4S is free to use any such Feedback, for any purposes whatsoever, including developing and marketing products and services, without any liability or obligation of payment or other compensation of any kind to you.  E4S may use Feedback without any restriction and without any obligation to keep such Feedback confidential.

Registration Information for Open Enrollment Classes

To register for a class, the request must be made in advance of the class start date via our Classes registration page. Payment or method of billing is preferred at the time of registration. Registrations without payment or method of billing are not guaranteed and may be forfeited at any time prior to receipt of payment or method of billing. Class sizes are limited, so we recommend registering early to guarantee a space in the class.

Payment Information for Open Enrollment Classes

Credit card payments will be processed at the time of registration. For registrations submitted without payment, invoices are sent three (3) weeks prior to the class start date, and payment is due within 30 days of the invoice date.

  • Debit cards
  • Checks (agency and cashier’s)
  • Electronic funds transfer (EFT)
  • Shopify Online Store (www.e4sprotraining.com)
  • Zelle payments

Payment by credit/debit card and will incur a surcharge of 3.0%. To avoid the additional charge, you may pay by cashier's check, or Zelle.

Once registered, the student will receive an email notification showing the registration has been completed. Additionally, the student will receive a class confirmation email no later than 1- 2 weeks prior to the class start date confirming that the class will be held.  Electronic course materials are included in the tuition fee.  For classes that have printed student materials, no additional fee will be charged.

If the class is full or has been rescheduled, notification of the change in class status will be sent via email.

Cancellations and Transfers for Open Enrollment Classes

Student substitutions are permitted at any time up to the start of a class.

  • 15 days or more prior to the start of the class
    • No charges will be incurred for cancelling or transfer of class registration.
  • 14 days or fewer prior to the start of the class
    • The full tuition is due. There is no credit available to transfer or refund. If rescheduling, an additional payment in the amount of the new registration will also be due.

Student No-Show for Open Enrollment Classes

If a student fails to attend class, the full tuition is due and there is no credit available to transfer or refund.

Refunds and Credits for Open Enrollment Classes

Refunds are made upon request only for registrations cancelled 14 calendar days or more prior to the class start date. Otherwise, a credit will be issued. Credits granted can be used for any future class.

Certificate of Completion for Open Enrollment Classes and Private Group Training

Full class attendance and successful completion of all course requirements (graded or not) are required to receive a Certificate of Completion. Qualifying students will receive a pdf copy of their Certificate of Completion by email within 3 weeks of the end date of the class. In case of illness or unavoidable emergency that results in partial attendance, makeup time may be scheduled on a space-available basis.

Student Conduct Policy for Open Enrollment Classes and Group Training

Students attending E4S classes are expected to be professional and courteous to other students, instructors, and E4S employees and contractors while attending a class.  This includes ensuring that you do not improperly use or present as your own someone else’s words, thoughts, or data in a class assignment.  Students must complete all individual assignments on their own without any use of generative artificial intelligence (AI) and/or help from other students.  Passing off any AI-generated content as your own isa violation of our Student Conduct Policy.  Professional conduct means that you do not engage in activity that provides an unfair or improper advantage in completing a course’s requirements. Further, in courses that require or allow student postings in E4S online forums, online portals, or platforms used by the company to deliver virtual classes, professional conduct consists of: (1) not using these systems to damage, disable, overburden, or impair those systems or interfere with any other party’s use and enjoyment of them; (2) not attempting to gain unauthorized access to these systems through hacking, password mining, or any other means; (3) not obtaining or attempting to obtain any materials or information stored on these systems other than those explicitly authorized by E4S; (4) not scraping or otherwise downloading in bulk any content on these systems, including but not limited to student postings, student information, online textbooks, course materials, trademarks, or logos; (5) not introducing or attempting to introduce viruses, trojan horses, worms, time bombs, corrupted files, malware, spyware, or any other similar software that may damage the operation of another’s computer or property; (6) not posting content that [a] defames, harasses, or threatens others, [b] discusses illegal activities with intent to commit them, [c] infringes another’s intellectual property, [d] is profane, pornographic, obscene, indecent, or unlawful, [e] constitutes advertising or any form of commercial solicitation, [f] constitutes information related to partisan political activities, and/or [g] is intentionally inaccurate or posted with the intent of misleading others. Failure to abide by this policy may result in a student’s dismissal from a course and/or forfeiture of tuition payment(s).

Intellectual Property Policy for Open Enrollment Classes and Group Training

By registering for or otherwise ordering an E4S class or training service, you agree and acknowledge that E4S training materials are protected by U.S. and international copyright laws. Therefore, you cannot reproduce, distribute, create derivative works of, or publicly display/perform such materials. In addition, you agree not to use the company’s training materials — including but not limited to the concepts and ideas expressed in the training — to create a competing product/service.

Student Content Disclaimer for Open Enrollment Classes and Group Training

You (the student) understand that when accessing and engaging with E4S online forums, online portals, or the platforms used by the company to deliver virtual classes, you will be exposed to other student content from a variety of sources and that E4S is not responsible for the accuracy, usefulness, reliability, or intellectual property rights of or relating to such student content.  You further understand and acknowledge that you may be exposed to student content that is inaccurate, offensive, defamatory, indecent, or objectionable; and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against E4S with respect thereto.   E4S does not endorse any student content or any opinion, recommendation, or advice provided/submitted by students in the company’s online forums, online portals, or the platforms used by it to deliver virtual classes. E4S does not have any obligation to monitor any student content or any other student communications submitted or made through E4S online forums, online portals, or the platforms used by the company to deliver virtual classes.  However, E4S reserves the right to review student content and to exercise its sole discretion to edit or remove, in whole or in part, any student content at any time and for any reason.  Without limiting the foregoing, upon receiving notice from a student that specific student content allegedly does not conform to E4S’ policies governing student content, E4S may investigate the allegation and determine in its sole discretion whether to remove the student content at issue, which it reserves the right to do at any time and without notice.

Nondiscrimination Policy for Course Attendees

E4S provides training opportunities to its customers and their employees who attend the company’s courses without regard to, and does not discriminate on the basis of:

  • Race
  • Color
  • National Origin
  • Religion
  • Age
  • Sex (including pregnancy, gender identity, and sexual orientation)
  • Disability
  • Genetic Information
  • Veteran status
  • Any other reason as provided by applicable Federal, state or local statute/regulation.

E4S prohibits any form of discriminatory harassment conduct based on a protected characteristic where such conduct creates a hostile environment or where enduring such conduct becomes a condition of continued access to a company’s training program or a training related decision about a course attendee.

E4S provides individuals with all assistance necessary to address a disability or special learning need in accordance with applicable laws and regulations.  E4S requires notice of at least 14 calendar days prior to the start of the class to ensure that any disability or special learning needs are addressed appropriately.  If such notice is not provided for an Open Enrollment class, the individual will be automatically rescheduled for the next session of the course.  For Group Training, an accommodation may not be guaranteed if notice is not provided.
